New CSR rules for India Inc rules out political funding

| Posted: 27 Feb 2014 06:24 AM PST CSR activities will have to be within India, and the new rules will also apply to foreign companies registered here The much awaited rules for implementation of corporate social responsibility (CSR) by India Inc, which were notified by the Ministry of Corporate Affairs (MCA) on Thursday, have excluded political funding from the ambit of activities that would qualify as CSR. The notification, which comes into effect starting April 1, clearly states that any contribution from companies made "directly or indirectly" to any political party would not be considered as CSR activity. The move assumes significance as it comes merely months ahead of general elections in the country. The new Companies Act, 2013 mandates companies having a net worth of Rs 500 crore or more; or a turnover of Rs 1,000 crore or more; or a net profit of Rs 5 crore or more to spend of at least 2 % of their average net profit of past three years on CSR activities. Last year, the government provided a new structure for political funding by corporates, under which companies can set up 'Electoral Trusts' for giving funds to registered political parties of the country. The new 'Electoral Trust' structure also provides for some tax benefits to these entities for funds provided to political parties. About a dozen entities including those linked to large business houses such as Ambanis, Tatas, Mittals, Birlas and Vedanta have already set up such trusts. The government's latest notification for implementation of corporate social responsibility (CSR) by companies cover a wide range of activities, where investments made by companies will qualify as CSR spend. Such activities include varied and diverse areas such as projects promoting preventive health care and sanitation, livelihood enhancement projects, protections of national heritage art and culture and steps for the benefit of armed forces veterans. MCA consulted various stakeholders including stalwarts of India Inc before finalizing and notifying the rules. "The rules provide for the manner in which CSR committee shall formulate and monitor the CSR policy, manner of undertaking CSR activities, role of the board of directors therein and format of disclosure of such activities in the board's report," Minister for Corporate Affairs Sachin Pilot said. With the rules in place now, various new areas such as livelihood enhancement and rural development projects, promoting preventive health care and sanitation as well as making safe drinking water available would be considered as CSR activities. Working towards protection of national heritage, art and culture including restoration of buildings and sites of historical importance and works of art, setting up public libraries, promotion and development of traditional arts and handicrafts would also come under CSR ambit. Various activities aimed at reducing inequalities faced by socially and economically backward groups have been included. Other CSR activities would be ensuring ecological balance, protection of flora and fauna, animal welfare, agro-forestry, conservation of natural resources and maintaining quality of soil, air and water. Notifications have been issued for Section 135 and Schedule VII of the Companies Act, 2013, that relate to CSR spending by companies.(Business Standard) |

High court's relief for employers, businessmen from paying penal fees for not filing TDS
In a big relief for several employers and businessmen, the Karnataka high court has stayed for four weeks the operation of series of demand notices sent by the Income Tax department asking them to pay penal fees in relation to non-filing of TDS statements.
Justice Jawad Rahim passed an interim order to this affect while asking Income Tax department and ministry of finance to file their replies.
Several employers as well as assessees under TAN have moved the court challenging the penal provisions under newly inserted section 234E of the Income Tax Act , 1961 connected to filing of TDS returns by employers.
"The incorporation of Section 234E to the IT Act with effect from July 1,2012 has at one stroke ,deleted all the favorable and beneficial sections- an appeal under section 246(1)(l)(ii) of the Act and also waiver of penalty under section 273B itself .Now it is mandatory and compulsory on the deductees to pay fee at Rs.200 per day till the date of filing/submitting the TDS statement to TDS reconciliation analysis and correction enabling system, Ghaziabad. Failing which, the deductor/s will be totally debarred from filing their TDS statement itself and as a further consequence , they will not be competent to issue Form No.16 or 16A as stipulated under section203 of the IT Act to the dedctee/s." the petitioners have stated.
"If they continue defaulting section 234E of the Act, then they would be further subjected rigorous penal provisions of having to shell out penalty at Rs.100 per day, as set out in Section 272A(2)(g), in case recipient/deductee claims credit of the TDS in his return of income tax" the petitioners have claimed.
The petitioners have stated that levy of fee is against the scheme of the Income Tax Act and the word 'fee' is an alien word by itself vis-a-vis the Income Tax Act.

US expands investigations against offshore tax evasion to India, Israel
PTIThe US has expanded its action against tax cheaters to countries such as India, Israel and Liechtenstein, a top US official told lawmakers on Wednesday.
So far, the US action was primarily focused against tax cheaters on Switzerland.
"While the (Justice) Department's initial efforts and this hearing have focused on Switzerland, we have expanded our investigations to go after tax cheats and the banks assisting them in India, Israel, Liechtenstein, Luxembourg, and several Caribbean countries," the Deputy Attorney General, James M Cole, told a Congressional committee yesterday.
Since 2009, the Department has publicly charged 73 account holders and 35 professionals with violations arising from their offshore banking activities, and 72 individuals have pleaded guilty or were convicted at trial, he said.
"Just as importantly our enforcement efforts have driven over 43,000 taxpayers with secret offshore accounts to identify themselves to the IRS, disclose their offshore accounts, and to pay a total of over $6 billion in back taxes, penalties and interest. And that number is growing," he said.
Cole said in 2013, the Department obtained four separate orders authorising the Internal Revenue Service (IRS) to issue John Doe summonses seeking records from banks in the US for the US correspondent accounts of banks located in the Caribbean, Switzerland, and other European countries and America has successfully compelled account holders to provide the US with personal records of their foreign banking activities.
Since the UBS deferred prosecution agreement in February 2009, the Department has taken public action against two other banks, he said, adding that in January 2013, Wegelin Bank, one of the oldest financial institutions in Switzerland, pleaded guilty to conspiracy to defraud the US and was ordered to pay substantial fines and to forfeit funds.
"As a result of its criminal conviction, Wegelin was forced to close its doors, which sent a shockwave through the community of banks and bankers in Switzerland that had been engaged in facilitating US tax evasion. In July 2013, Liechtensteinische Landesbank AG entered into a non-prosecution agreement, and paid substantial fines," he said.
"What is particularly notable about this case is that we were able to ... have Liechtenstein actually change its bank secrecy laws retroactively. This enabled the department to obtain files relating to non-compliant US account holders," he said.
"In August 2013, the department publicly stated that 14 banks have been authorised for investigation concerning the use of Swiss bank accounts. This is in addition to on-going investigations concerning cross-border activities by banks in India, Israel, Liechtenstein, Luxembourg, and several Caribbean countries," Cole added.
